Court Doubles Damages Against SeaChange in Patent Case

A Delaware District Court has doubled the damages for nCUBE in its patent infringement case against SeaChange International.

The court awarded nCUBE $4,071,658 against SeaChange, along with prejudgment interest of $62,101 and two-thirds of nCUBE's attorneys' fees and other costs totaling $1,839,852.

Two years ago, nCUBE filed a patent infringement suit against SeaChange, accusing the Maynard, Mass.-based video server company of illegally using nCUBE's VOD technology in its products. A jury decided in favor of nCUBE in May 2002.

SeaChange said that it expected the damages to be higher, and, as a result, will be able to favorably adjust its previously reported financial results for FY2003. The company said it is appealing the case. SeaChange also has pending damages against nCUBE over patent infringement over SeaChange's MediaCluster technology.
